T's Wireless was accused of illegal weed sales and was shut down last month.

SYRACUSE, N.Y. (NCC News) –  A judge will grant T’s Wireless at 401 S. Salina St. a temporary restraining order, pending an official signature from the court, according to representatives from Nave Law Firm.

The local retail shop was declared “unfit for human occupancy” by the city’s Department of Code Enforcement last month, which lead to its subsequent shutdown. T’s Wireless has since filed a lawsuit saying that the city violated its business rights in response.

This morning, after a legal hearing attended by both parties, the court will allow T’s Wireless to re-open,  attorney’s Brady O’Malley and Dennis Nave said.

The lawsuit claims that Mayor Ben Walsh quickly photographed jars of hemp displayed inside the store and left within 20 seconds of his arrival.

Almost exactly 24 hours after Mayor Walsh’s “inspection,” around 1:00 p.m. on September 12, 2023, T’s Wireless was raided without a warrant or consent by armed agents of the New York State Office of Cannabis Management (“OCM”) and Department of Taxation & Finance (“DTF”), who  collectively seized approximately $19,400.00 in T’s Wireless property.

Other claims include that the city is overstepping its legal authority, and names the city of Syracuse and Deputy Commissioner of Code Enforcement Jake Dishaw as defendants.

O’Malley says that there will be another court hearing in December to determine whether or not T’s Wireless is fit to remain in business.
